“PROGRAM
In February 2016, the en banc Federal Circuit decided Lexmark v. Impression Products, which may result in a landmark Supreme Court decision later this year or in early 2017, regarding the common law patent exhaustion doctrine. The disputes relate to core issues facing many patent owners: when does the patent owner’s ability to enforce its patent end, and how may a patent owner impose restrictions that continue after the sale of patented goods. This presentation will explain the current law of patent exhaustion and the parties’ key arguments, and explain how to plan ahead for the potential changes in the law resulting from a future Supreme Court decision.

PRESENTER
Matthew Blackburn is the Managing Partner of the Locke Lord LLP San Francisco office. Matt has served as a lead attorney and trial counsel in patent infringement litigation, counseled clients concerning intellectual property portfolio development and rendered freedom to operate opinions on a wide array of technologies. He is currently the chair of the ABA IP law section patent litigation committee.”
