Software patents – a target for some, a rallying cry for others – have been a focus of debate across all sectors of patent practice, from procurement, to post-grant review, to litigation. The Supreme Court’s recent decision in Alice Corp. v. CLS Bank, affirming the plurality (not majority) Federal Circuit opinion, is the judiciary’s latest contribution to that debate.
